Welcome to shoplittlebirdies.com (the "Site"), operated by [Little Birdies Boutique, LLC] ("Little Birdies," "we," "us," or "our"). Please read these Terms of Use (the "Terms") carefully. By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Return & Exchange Policy, each of which is incorporated by reference. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old to make a purchase or create an account. By using the Site, you represent that you are 18 or older and that all information you provide is accurate and current. The Site is hosted in the United States and intended for U.S. users. If you access it from elsewhere, you do so at your own risk and are responsible for compliance with local laws.
2. Orders, Pricing & Availability
All orders are offers to purchase and are subject to our acceptance. We may refuse, limit, or cancel any order at any time, including for suspected fraud, resale, pricing or listing errors, or unavailability. If we cancel after payment, we will issue a refund to the original form of payment.
Prices are in U.S. dollars and may change without notice. We strive for accuracy, but errors in pricing, descriptions, images, or availability may occur, and we reserve the right to correct them and to cancel affected orders, even after confirmation. Product colors may vary from what appears on your screen. Sales tax is calculated at checkout based on the shipping address.
3. Payment
You represent that you are authorized to use the payment method you provide. Payment is charged at the time of order. We use third-party payment processors and do not store full card numbers. Promotional codes are one per order, non-transferable, may not be combined, and may be withdrawn at any time.
4. Shipping & Risk of Loss
Shipping timelines are estimates, not guarantees. Title and risk of loss pass to you when we deliver the package to the carrier. We are not responsible for lost, stolen, delayed, or misdelivered packages once tendered to the carrier, or for packages sent to an incorrect address provided at checkout. Claims for carrier loss or damage are your responsibility to file. See our Shipping Policy for details.
5. Returns & Exchanges
All purchases are subject to our Return & Exchange Policy. Certain items, including sale, custom, monogrammed, engraved, and made-to-order goods, are final sale. We reserve the right to refuse returns that do not meet the policy's terms.
6. Gift Cards & Store Credit
Gift cards and store credit are not redeemable for cash except where required by law, are not replaceable if lost or stolen, and may not be resold. Store credit expires one year from the issue date. We are not responsible for unauthorized use of gift card or store credit codes.
7. Custom & Personalized Items
You are responsible for the accuracy of spelling, monogram order, and personalization details submitted. We are not liable for errors in customer-supplied information. Personalized items are final sale and cannot be canceled once production has begun.
8. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts at our discretion.
9. Marketing Communications
By providing your email address or phone number, you consent to receive marketing communications from us. Text-message programs may involve recurring automated messages; consent is not a condition of purchase, message and data rates may apply, and you may opt out at any time by replying STOP. You may unsubscribe from email via the link in any message.
10. User Content
If you submit reviews, photos, comments, or other content ("User Content"), you grant Little Birdies a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, and display it in any media, including for marketing, with or without attribution. You represent that you own or have rights to the User Content, that it does not infringe any third party's rights, and that it contains no images of children other than your own or those for whom you have parental authority. We may remove User Content at any time. Any ideas or suggestions you send us are non-confidential and may be used without compensation.
11. Prohibited Uses
You agree not to: use the Site for any unlawful purpose; purchase for resale without our written consent; use bots, scrapers, or automated tools; attempt to interfere with the Site's security or operation; impersonate any person; upload malicious code; or infringe our or any third party's intellectual property.
12. Intellectual Property
All content on the Site, including text, images, photographs, graphics, logos, product designs, and software, is owned by or licensed to Little Birdies and protected by U.S. and international copyright and trademark law. "Little Birdies Boutique®," "Pineapple Sunshine®," and our logos are our trademarks and may not be used without prior written permission. You may view and print Site content solely for personal, non-commercial shopping purposes. Any other use, including framing, scraping, or reproduction, is prohibited. Third-party trademarks on the Site belong to their respective owners.
13. Copyright Complaints
If you believe content on the Site infringes your copyright, send a notice compliant with the Digital Millennium Copyright Act to hello@shoplittlebirdies.c o m.
14. Third-Party Links & Services
The Site may link to third-party websites or use third-party services (payment processors, shipping carriers, registry platforms). We are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.
15. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PRODUCTS INTENDED FOR INFANTS AND CHILDREN MUST BE USED UNDER ADULT SUPERVISION AND IN ACCORDANCE WITH MANUFACTURER INSTRUCTIONS AND AGE RECOMMENDATIONS.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LITTLE BIRDIES AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17. Indemnification
You agree to indemnify and hold harmless Little Birdies and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your User Content, or your misuse of the Site.
18. Dispute Resolution & Arbitration
Please read this section carefully. Any dispute arising from these Terms, the Site, or any purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court. You and Little Birdies waive the right to a jury trial and to participate in a class action. Before filing, the party raising the dispute must send written notice to the other and allow 30 days to resolve it informally. You may opt out of this arbitration provision by emailing hello@shoplittlebirdies.c o m within 30 days of first accepting these Terms.
19. Governing Law
These Terms are governed by the laws of [the District of Columbia / the Commonwealth of Virginia/the Commonwealth of Maryland], without regard to conflict-of-law principles. 20. Termination

21. Changes to These Terms
We may update these Terms at any time by posting a revised version with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance. The Terms in effect at the time of your order govern that order.
22. General
These Terms, together with the policies incorporated by reference, are the entire agreement between you and Little Birdies regarding the Site. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them without restriction.
